Welcome to goCofwe. These Terms of Service ("Terms") govern your access to and use of the goCofwe website, services, applications, and capacity reservation tools.
1. Agreement to Terms
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
2. Description of Services
goCofwe provides a platform for team collaboration, freelancer matching, project management, and capacity allocation engineering. Users can declare weekly capacity, offer freelance services, create project workspaces, and assign deliverables to team members.
3. User Accounts & Eligibility
goCofwe is for users in India. You must be at least 18 years old and able to form a binding contract under the Indian Contract Act, 1872 to use goCofwe. You are responsible for the accuracy of your profile, for keeping your credentials confidential, and for all activity under your account. One person may not operate accounts that misrepresent identity, and usernames are non-transferable handles tied to your verified profile.
4. Roles & Responsibilities
- Clients (project owners): define opportunities, slots, and deliverables; fund agreed milestones; review submitted work in good faith; and pay accepted work on the agreed terms.
- Specialists (freelancers/builders): provide accurate skill, reputation, and availability information; honor committed allocations and schedules; and deliver work meeting the agreed specification.
- Builders collaborating on client projects: follow the project's workspace rules and the inviting organization's policies in addition to these Terms.
- goCofwe: operates the platform, enforces capacity and payment rules, and provides dispute-support tooling. goCofwe is not a party to the contract between client and specialist.
5. Capacity & Allocation Rules
Users agree that declared weekly capacity is a binding allocation limit. The platform enforces capacity reservation rules to prevent double booking. Specialists must fulfill committed hours according to agreed project schedules.
6. Payments, Fees, Refunds & Disputes
- Platform fee: goCofwe charges a platform fee on paid engagements, shown and confirmed before any charge is finalized. Fees are displayed in the project's commercial overview.
- Processing: payments are processed by third-party payment processors (currently Razorpay, via Payment Links). goCofwe does not store full card numbers. Client-to-specialist payment flows are initiated through the platform; settlement occurs through the processor's rails.
- Refunds: a client may request a refund for undelivered or non-conforming work before accepting the deliverable. Accepted deliverables are final except where required by law.
- Disputes: parties should first use the project workspace to resolve disagreements. If unresolved, either party may escalate to [email protected] within 14 days of the contested charge; we will review workspace records and mediate. Card-network chargebacks initiated without contacting us may lead to account suspension pending resolution.
- Currency and GST: all prices are in Indian rupees (INR). Each party is responsible for its own taxes on engagements.
7. Intellectual Property
Unless the project agreement says otherwise, deliverables created by a specialist for a client are assigned to that client upon full payment, including intellectual-property rights; the specialist retains the right to reuse general skills, know-how, and non-confidential portfolio references. Pre-existing tools, libraries, and frameworks remain with their original owner, with the client receiving the license needed to use the delivered work. goCofwe retains all rights in the platform itself.
8. User Content & Conduct
You keep ownership of content you post, and grant goCofwe a non-exclusive license to host and display it as needed to operate the Services. You are responsible for your content and for having the rights to post it. You agree not to post deceptive, offensive, unlawful, or infringing content, nor attempt to bypass security boundaries, authorization checks, or system rate limits. Prohibited uses include fraud, money laundering, sanctions evasion, scraping or enumeration of other users, harassment, and misrepresenting identity, skills, or work history. We may remove content that violates these Terms; liability for user content rests with the user who posted it, to the extent permitted by law.
9. Independent Contractor Classification
Specialists and builders act as independent contractors, not employees, agents, or partners of goCofwe or of clients, unless a separate written agreement says otherwise. Nothing on the platform creates an employment relationship. Specialists are responsible for their own permits, visas, and freelance or trade licenses required in their jurisdiction (including GST registration where the law requires it).
10. Organizations & Multi-Tenant Use
Organization administrators are responsible for their members' access, for the lawfulness of workspace data they manage, and for honoring commitments made to specialists through their workspaces. Organizations must not use workspace data for purposes unrelated to the engagement, and must honor member removal and data requests as described in the Privacy Policy.
11. Suspension, Termination & Appeals
We may suspend or terminate accounts that violate these Terms, create risk for other users, or fail payment obligations, with notice where practicable. You may close your account at any time from Settings; open commitments must be completed or resolved first. If your account is suspended or terminated, you may appeal within 30 days by emailing [email protected]; a human reviews every appeal. We may modify these Terms with reasonable advance notice for material changes.
12. Disclaimers & Liability
The Services are provided "as is" without warranties to the extent permitted by law. goCofwe is not liable for the quality, legality, or delivery of work contracted between users, nor for indirect or consequential damages. Our aggregate liability is capped at the platform fees you paid in the 12 months before the claim. Nothing in this section limits liability that cannot be limited by law.
13. Governing Law & Disputes
These Terms are governed by the laws of India. Disputes are first handled through our grievance process in section 14. If a dispute is not resolved, it may be taken to the courts of competent jurisdiction in India, without limiting any right you have as a consumer under the Consumer Protection Act, 2019.
14. Grievance Officer & Contact
For complaints or questions about these Terms, the platform or a payment, write to our Grievance Officer, Fahmin Fayas, email [email protected]. We acknowledge a complaint within 24 hours and aim to resolve it within 15 days (the shorter of the timelines in the IT Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020).
